The court hearings we have been preparing for almost four years are scheduled for Friday, February 15th. According to our attorney, it will be helpful to have as many people as possible from CNW and the community attend the hearing, so please attend if you can! This is a culmination of all your public testimony and financial support, CNW’s technical presentations, and our attorney’s labor up to this point. Please come and bring your neighbor too!
Phoenix Development’s appeal of the Woodinville City Council’s decision to deny the re-zone for the Wood Trails and Montevallo developments will be heard Friday, February 15th at 9:30 AM in room E(east)-713 of the King County Court House. The King County Court House located at 516 - 3rd Avenue in downtown Seattle. The presiding judge will be the Hon. Dean Lum. The hearing should be finished by noon unless something unusual happens. It is possible, but unlikely, that Judge Lum will rule on Phoenix's petition at the hearing. More likely, he will take the matter under advisement and either a) send a written opinion or letter or b) call us back at a later time to make an oral ruling. A deferred ruling could take a month or so.
Parking in downtown, Seattle is expensive and scarce, so please consider taking the bus or carpooling. If you drive, please give yourself extra time to find parking. Please be on time! The hearing starts at 9:30 AM sharp.
A heartfelt thanks to all neighbors who have voiced their support of CNW by making generous financial contributions and pledges to our legal fund. We still need to raise additional funds. If you haven’t contributed yet, please consider stepping up to help preserve your neighborhood.
LUPA Appeal document filings are in full swing. We will be posting them to our site as they become avaialble.
Jan 7 - In their opening brief, Phoenix Development attempts to claim that the City Council had no basis for its decision to deny the re-zone. You will remember that the CNW Team and our attorney, Rick Arambaru, prepared an extensive technical and legal document to defend against such a claim and ensured it was included in the original decision's official record.
Jan 28 - The City of Woodinville Response to Opening Brief and the CNW Opening Brief both rebut Phoenix's claim. The city also submits a motion to strike parts of the Phoenix brief addressing items not included in original decision's official record. CNW joins this motion to strike.
Feb 1 - Phoenix Development submits a motion for leave to file an Amended Land Use Petition and Complaint for Damages.
Feb 4 - Phoenix Development submits a Reply Brief.
We appreciate your past support, and ask for your continued financial support to help fend off this developer's ongoing challenges to our neighborhood character and safety.
